The Constitution provides for its own amendment that is, for changes in its written words. Article V sets out two methods for the proposal and two methods for the ratification of constitutional amendments, creating four possible methods of formal amendment.
First, an amendment may be proposed if two-thirds of both houses of Congress approve the amendment and agree to send it to the states. An example of this would be Prohibition.
Second, an amendment can be proposed if Congress calls for a national convention at the request of two-thirds of all of the state legislatures. An example of this would be... Harvard Law School professor Lawrence Lessig has called for a constitutional convention to draft a Second Constitution of the United States.
Ratification can occur in one of two ways:
One method is for three-fourths of all state legislatures to ratify the amendment by a positive, or yes vote.
The second method is through special conventions called in each state for the specific purpose of ratifying the proposed amendment. An Example of this would be... In Florida, the convention is made up of 67 members. The governor has 45 days to call an election to be held from five to ten months after Congress proposes the constitutional amendment.
